Notes: Though family history says theory was 2 children ( Gertrude and Lonnie ) born to catherine before Jennie Davis, no actual proof of this has been found. However , it is possibly now that we know the marriage date of Catherine and James Henry Davis was 1877 and Jennie was born in 1881.Perhaps Will Ns Kate was not married at all. There is a conflict regarding Kate’s Marriage to Will Irvin(Irwin). According to records in Bandera co TX, she was married to James Davis 1/29/1877, Willie Irvin , her daughter , is shown to have been born in 1878 on her (WILLIE"S) death certificate. If Kate was married to Will Irvin prior to James Davis, Willie’s date of birth must be incorrect, but why would her name be listed as McDonald on the marriage license to James Davis? Perhaps Kate and Will were not married at all. Also a witness to the marriage License of Kate’s sister , Sarah in bandera co, TX was a D. P, Irwin. Is he a connection to Will Irvin? Will Irvin was born in Texas???Kate was married to James Henry Masoner-Davis ( son of Henry Masoner & Lucinda Castle) on 1/29/1877 in Bandera co TX. Married by Joseph Dial, Minster of Gospel. James H Masoner-Davis was born in 14856 in TN. He died Aug/Sep 1884 in Bandera co Texas. Family history says he killed a man in Idian territory after an argument . And fled to Bandera co, Texas where he changed his name to Davis ( his stepfather was Robert Davis) , but there is no proof of this and the story possibly pertains to relative, his nephew , Richard aka Charles Matthew Scott. James Henry May have left Montague County in 1875 before the court case mentioned below. James supposedly died of anthrax contracted while dipping sheep, 3 months after his son Ben Lee was born.Katie Married Charles "Charlie" A. Freeze was born in 1867 in Alb. He died on 9/29/1941 in Graham, Young Texas. Vol. 2, pg 99, Wills Proabted Yopung Co , Tx1920-1959- index list C.A. Freeze

State of Texas Vs James Masoner and Theft

William Johnson Nov 16th 1875

This day cause was regularly reached for trial. There upon came the district attorney and the defendant James Masoner came not but wholly made default and it appearing to the court that the defendant James Masoner as[principal and J. C McCrakers, Robert Davis, Jesse Davis, J. A. Johnson, J. T. Kelly , William Davis. H.C. Justin, and S.W. Brown as securities have entered into recognition in the sum of seven hundred and fifty dollars ($750.00) conditioned that the defendant James Masnoer would personally appear at this term the court and the answer the indictment in this cause no.457 wherein the said defendant is charged with the crime of theft of hogs and the said defendant and his securities having been three time distinctly called at the court house door and said securities failing to produce the body of said defendant in court . It is therefore considered by the court that the said recognizance be forfeited and that the state of Texas to have and recover of the said defendant and his said securities the sum of seven hundred and fifty dollars to made final at the next term of this court unless cause be shown for failure to appear and that scirefacias issue to said securities.

Graham Resident Killed Near Cisco Car Overturns

Mrs. C.A. Freeze Died Early Today After Arm Amputation

Word was received from Cisco this morning with Mrs Freeze , injured in automobile accident Friday afternoon, had died early today in the hospital there. Mr. And Mrs. Funderburgh, who with Mrs. Freeze were en route to Colman to visit relatives. The car overturned six miles from Cisco when the left rear tire blew out, causing the car to leave the road and pin all three occupants under the wreckage.

Passerby stopped to give aid and took the Graham people to the Cisco hospital where a blood transfusion was made in an effort to save Mrs. Feeze. Amputation of her right arm was also necessary.

Mr. Funderburg was driving and suffering head injuries while his wife sustained chest injuries.

Mrs. Freeze leaves 3 daughters : Mrs. F.P. McFadin, Mrs, W.P. Funderburgh, And Mrs. Gene Robinson. Of Eastland: four sons B.C. And Monty Freeze, both of Graham: Ben and Jim Davis of Colman: 1 Step daughter- Mrs T.R. Adams of Oakland, CA

Funeral arraignments had not been made at the press

She was buried on June 2nd 1935 in Oak Grove Cemetery, Graham, Young County, Texas. Cathriene’s daughter wrote that her mother had black hair and blue eyes

Catharine "Kate" McDonald was botn on April 23rd 1859 in Nacogdoches County Texas. She died on June 1st 1935 in Cisco Eastland county Texas . Died as a result of a car accident 5 miles north of Cisco, Texas, the car was drivin by Paul Funderburg husband of Bessie Freeze, ( PaPa Davis half sister Aunt Bess) She was pronounced dead at 10:15 am from concussion of the brain and traumatic amputation of her right arm.
